The following terms and conditions constitute a sales contract between Colleen O’Keefe, Limberlost Welsh Springer Spaniels (hereafter referred to as the Seller) and John Doe (hereafter referred to a Buyer). The puppy (hereafter referred to as dog) is from a litter out of CH Father (SFXXXX) and CH Mother (SNXXXXXX) born 1-1-2000 and has a limited registration number SNxxxxxx/xx.  The AVID microchip number is 000* 000 *000. These terms and conditions are entered into and agreed upon by both Buyer and Seller, and they acknowledge the moral and legal worth of this contract.

Therefore it is agreed that:

1.  This dog is sold for the price of $***.** (with $100.00 refunded upon proof of neutering). A $***.** nonrefundable deposit is required to hold the dog for the Buyer. The remainder is payable upon delivery of the dog. If the dog is to be shipped the remainder is to be paid prior to shipping. This deposit assures that a dog is available to the Buyer. If the initially agreed upon dog becomes unavailable it will be replaced with a dog of equal or higher quality. The deposit will be refunded if no dog is available due to lack of quality or illness or it comes to the attention of the Seller that the Buyer could not provide a suitable home for the dog.

2.  This dog may never be sold or given away or transferred to any group or individual, except back to the Seller, in forfeit of purchase price, in which case the dog’s AKC certificate shall accompany the dog, signed over to the Seller as sole owner of the dog. Any other transfer of this dog without the Seller’s written permission shall make the Buyer liable for $2000.00 (two thousand dollars) in punitive damages payable on demand to the Seller.

3.  This dog is to be kept in the commonly accepted way of a beloved family pet. The purpose of this clause is to prevent the dog from being isolated from the family and being kept exclusively in a kennel, run or tied outside. If it occurs that the dog is being neglected by prolonged isolation from the family, the dog must be returned to the seller.

4.  The Buyer may not use this dog for breeding until the age of 18 months provided the following conditions are met:

The dog has achieved an AKC championship.

The dog has a preliminary OFA hip clearance of good or excellent. If the dog receives a clearance of less than good no breeding may occur until after the age of 2 years when the final hip certification is made.

The dog may never be bred without having the hips certified clear of dysplasia.

The dog may never be bred if the dog has a seizure (fit); a littermate to the dog has a seizure or bred again if the dog produces a seizure.

5.  If the dog is bred in violation of paragraph number 5 either by mistake or design, the Buyer is liable to pay $2000.00 (two thousand dollars) in damages to the Seller. It is understood that this agreement is an attempt to protect the Welsh Springer Spaniel and the integrity of the Seller’s bloodlines.

6.  The Buyer agrees to provide proper veterinary care including annual vaccinations, parasite checks, and any preventive health care as recommended by a veterinarian. Except in emergency situations, if euthanasia is being considered the Buyer must contact the Seller to maintain the contract. If for humane reasons the euthanasia occurs prior to contact with the Seller a written statement from the veterinarian is required. The purpose of this clause is to prevent euthanasia of a geriatric or otherwise healthy Welsh Springer that has outlived the usefulness in the home. In this case it is much preferred that the dog be returned to the Seller.

7.  The Seller guarantees the dog to be free from any congenital or genetic defect or unsound temperament that would not allow the dog to live a comfortable life as a family pet until the age of 7 years. If a condition arises in which the dog has to be euthanized or dies then the Seller will replace the dog with a dog of equal or higher value from a litter of 4 or more within 2 years after the death of the pet. This clause would be void if the loss of the pet occurred because of accident, neglect, abuse or negligence as determined by the Seller.
